DaxieBoyToys.com does not intentionally collect personal information about children under the age of 13. Children under the age of 13 may not use this Site other than for browsing, and parents or legal guardians may not agree to these Terms of Use on their behalf. If you are a parent or legal guardian agreeing to these Terms of Use for the benefit of a child between the ages of 13 and 18, be advised that you are fully responsible for his or her use of this Site, including all financial charges and legal liability that he or she may incur. If you do not agree to (or cannot comply with) any of these terms and conditions, do not use this Site. All billing and registration information provided must be truthful and accurate. Providing any untruthful or inaccurate information may constitute a breach of these Terms of Use. By confirming your purchase at the end of the checkout process, you agree to accept and pay for the item(s) requested.

Any dispute arising from the use of this site, or transaction with this site, is binding to the state of Texas.

QUANTITY LIMITS & DEALER SALES:

DaxieBoyToys.com reserves the right, at our sole discretion, to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same credit card and also to orders that use the same billing and/or shipping address. We will provide notification to the customer should such limits be applied to an existing order.

PRICING INFORMATION:

While DaxieBoyToys.com strives to provide accurate product and pricing information, pricing or typographical errors may occur. DaxieBoyToys.com cannot confirm the price of an item until after you order. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, DaxieBoyToys.com shall have the right, at our sole discretion, to refuse or cancel any orders placed for the item. In the event that an item is mispriced, DaxieBoyToys.com may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation.

PRODUCT AVAILABILITY:

The availability of each item we sell on DaxieBoyToys.com is shown on the product description page. Most items are in stock and available to be shipped within 48 hours of when you place your order Monday through Thursday. (By “shipped,” we mean the item has left our fulfillment center.) Because our goal is to offer you the hottest items as soon as possible, some items may be en route to our fulfillment center when you place your order. We will estimate the availability of these items for you. The availability of any item we sell is subject to change.

SHIPPING ADDRESS:

When providing us with shipping information, please enter a street address along with any suite or apartment numbers. We are currently shipping WORLDWIDE!

International buyers you will be able to see shipping charges before you pay. You will have to go through the checkout process before the shipping charges will be displayed.

When you set up your account, you can establish a shipping address to use on all orders.

SHIPPING OPTIONS:

We offer you three shipping options to meet your needs. Consider how quickly you would like to receive your order to help you choose a shipping option. Currently, our shipping options are as follows (please allow extra shipping time for orders delivered to Alaska, Hawaii, Puerto Rico, U.S. Virgin Islands, and of course theses shipping times do not apply outside the US):

     · Standard Shipping: Allow 7-14 business days from date shipped (Ships via U.S. Postal Service or FedEx)

     · Priority Shipping: Allow 3-6 business days from date shipped (Ships via U.S. Postal Service or FedEx)

     · Express Shipping: Allow 1-3 business days from date shipped (Ships via U.S. Postal Service or FedEx)

If all items are in stock, standard and priority orders will ship within 48 hours for delivery within 7-14 business days for standard shipping and 3-6 business days for priority. If all items are in stock, express orders are shipped within 24 hours for delivery within 1-3 business days. Most express orders placed before 11:00 am EST will ship the same business day (Monday through Thursday, excluding holidays) if all items are in stock.

Please note that orders placed on weekends or holidays will begin processing on the next business day.

Items With Free Shipping Will Be Mailed Using A Standard Shipping Service Unless Otherwise Noted

SHIPPING COST:

Your shipping cost depends on the shipping option you choose.

When your order consists of multiple items, we will always attempt to group your items into as few shipments as possible. At times, when your order contains multiple items, it may be necessary to send your items in separate shipments to ensure that you receive them in a timely manner. If this occurs you will only be charged for shipping once. The shipping charge for your order will be displayed on the order summary page just before you submit your order.

We hope that you are completely satisfied with your order. If, for any reason, you are not satisfied, you may return most items sold by DaxieBoyToys.com within 5 days of delivery for a replacement or a credit. If a credit is issued, the purchase price of the item plus any applicable sales tax will be credited. The shipping charges will not be refunded and it is the buyers responsibility to pay for the return shipping of the item.

COMPLETING THE RETURN:

You are a valued customer, and we want your shopping experience with us to be hassle-free. If you do need to return an item to us and the item is eligible for return, please e-mail us at daxieboytoys@gmail.com and let us know what items you will be returning, the reason for return, your invoice number which can be found in your account page online and whether you would like a replacement if available or a credit.

PACKING AND SENDING YOUR RETURN:

1. Please e-mail us at daxieboytoys@gmail.com.

2. Indicate the action you would like us to take (replacement or credit) and the Reason for Return. Please provide your e-mail address and phone number so that we may contact you if there are delays in processing your return.

3. Pack the items securely in a box. You can use the box the items arrived in or another box, if you prefer.

4. Affix a shipping lable and the correct postage securely to the outside of the box.

5. Bring the package to any Post Office or leave for your mail carrier to pick up.

RETURNING FREE GIFTS OR PROMOTIONAL PACKAGES:

We occasionally offer promotional packages and free gifts with purchase. If you would like to return an item for which you received a free gift, you must also return the free gift in order to receive a credit. Items sold as part of a promotional package may not be returned separately for credit. For example, if you purchase two items sold together as a promotion, and you would like to make an eligible return for a credit or exchange, you are required to return both items together. If an item sold as part of a promotional package arrives damaged or defective, it may be returned for replacement.

REQUESTING A REPLACEMENT:

We will replace an item for the same item if it arrives damaged. When requesting an eligible replacement, please indicate if you would like a replacement of the same item shipped to you at no cost. At this time, exchanges for different items are not possible, but you are welcome to place a new order on our website at www.DaxieBoyToys.com. If the item you would like to replace is no longer available we will contact you and provide you with a credit.

REQUESTING A CREDIT:

When requesting an eligible credit, you will be credited the purchase price of the item. We cannot issue a credit to gift recipients; however, you may request a replacement if the item is damaged.

INELIGIBLE RETURNS/REPLACEMENTS:

We cannot accept for return or replacement any item that has been opened, unless it arrived damaged. If an item was sold as a set, individual elements of that set cannot be returned for a credit. (Please return the entire set if you are requesting an eligible credit or replacement).

MISSING INVOICE:

If you ordered an item that you want to return but can't find the invoice, please go to your account page and look up the invoice or contact our Customer Service Center via e-mail at daxieboytoys@gmail.com.

PROCESSING YOUR RETURN:

Please allow 21 days to process your return. You will receive notification via e-mail or U.S. mail confirming that your return has been received and processed. If, after 21 days, you still have not received e-mail or written confirmation that your return has been processed, please contact our Customer Service Center at daxieboytoys@gmail.com.

UNDELIVERABLE SHIPMENTS:

When packages are returned to us as undeliverable, we will attempt to contact you via phone or e-mail in order to obtain a different shipping address to re-ship the order. If you are concerned that there may be an issue with delivery of your order, you can e-mail us at daxieboytoys@gmail.com.

CANCELING OR CHANGING AN ORDER:

Once an order has been submitted, it can not be cancelled. If there is a problem with the order you can return the item for a credit.
